RENTAL
AGREEMENT
This Rental
Agreement, made and entered into on this____________________, between
Swordfish, LLC its agents and attorneys hereinafter (“Swordfish
LLC")
and
___________________________(Name) of
(Street),
(State),
(Zip Code) (hereinafter “Guest”).
THE
PARTIES AGREE AS FOLLOWS:
1.
Swordfish, LLC
does hereby rent and lease to Guest the following described property:
26700 Willow Gulch Drive, Clark, Colorado 80428 under the terms and
conditions as hereinafter stated for the term of
_______________________(dates reserved).
2.
The words “Swordfish LLC”, “Agent” and “Guest” as used herein
shall include the above named parties, their heirs, assigns and
representatives.
3.
Guest shall pay
Swordfish, LLC an initial deposit equal to 50 percent of
reservation cost at time of reservation, with the balance and $500
damage deposit paid to
Swordfish, LLC 30 days prior to arrival.
Damage deposit will be returned within a maximum of 21 days after inventory
and inspection of premises finds no damage has occurred to the property
or contents therein. Non-payment of reservation deposit, reservation balance, and
$500 damage deposit
or non-submittal of rental agreement 30 days prior to arrival will be subject to the following cancellation
policy:
A.
Guest will be refunded reservation balance, less a handling charge equal to one
night's lodging for the appropriate season, and full
damage deposit.
4.
Guests are responsible for payments of all nights reserved,
regardless of actual arrival and departure dates.
Swordfish LLC cannot vary from cancellation policies contained herein.
5.
Electricity and gas shall be
provided by
Swordfish, LLC.
6.
Major snow removal will be performed by
Swordfish, LLC. Minor snow
removal will be performed
by Guest. Guest will not use ice melting agents on Swordfish
concrete due to its corrosive nature. Guest will be held
financially responsible for damage to Swordfish premises due to ice
melting agents.
7.
Guest is responsible for providing cell phone if phone service is
desired. Reception is
minimal. There is no phone
at Swordfish. Phone services and wireless internet are also available at the Clark
Store and Glen Eden in Clark.
8.
Guest may not, without prior written consent of the
Swordfish, LLC, assign
this Agreement or any interest thereunder, or sublet the premises or any
part thereof, or permit the use of the premises by any other party,
other than Guest and his/her invitees.
9.
Guest agrees to hold
Swordfish, LLC and agents harmless and free from
liability for any injury to Guest, his servants, invitees, or other
persons while in or on the premises occupied by Guest and to repay and
indemnify
Swordfish, LLC and its agents for all expenses incurred arising out of such
injury, including attorney’s fees and court costs.
10. Guest agrees that all personal property brought into the premises
shall be at the risk and responsibility of Guest, and that Swordfish LLC
and its agents shall not be liable for theft thereof, or any damages thereto
occasioned for any Guest, co-tenants, invitees or other occupants of the
premises.
11. Swordfish, LLC shall have the right to any interest earned from prepaid
deposits or payments held in interest-bearing escrow accounts.
12.
Guest agrees to use
Swordfish, LLC’s furniture, appliances, televisions,
and household accessories and linens reasonably, and to leave these
items in the premises and in their current condition, natural wear excepted, and to be responsible for the damage or theft of these
items during the term of this Agreement.
If damage is discovered, or extra housekeeping is required, Guest
agrees to pay either replacement cost for damaged item(s) or
housekeeping fees.
13.
Guest is responsible for all damage to the internal and external
premises due to Guest's actions. This includes fires on the
premises, any damage to the structure, or other Guest actions.
14.
At the termination of this Agreement, Guest shall surrender
premises and return keys thereto to
Swordfish, LLC in the same
condition as at the commencement of the term, natural wear accepted. Guest further
agrees to the following:
A.
Check-in between 1:30 – 9:00 p.m.
B.
To not permit pets or animals within the premises.
If I am found to have pets I agree to board my pets at my own
expense and pay a $200 non-refundable fee to
Swordfish, LLC.
Further violations of this policy will be subject to immediate
eviction with no refund.
C.
To not smoke within the premises. Smoking is allowed on the deck.
I will dispose of butts in provided ashtrays.
D.
To clean-up house, dishes and dispose of garbage in cans located outside the premises
prior to leaving. Basic housekeeping services prior to rental are provided by
Swordfish, LLC and include: dusting, mopping and laundry.
E.
Close and lock all windows and outside doors prior to leaving.
F.
Check-out at 11:00 a.m. In
the event of late check-out, without
Swordfish, LLC approval, I may be charged an
additional night’s lodging to be determined by
Swordfish, LLC.
G.
Replace keys in lock boxes as located upon
arrival.
